Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kuruvi (the "Service"), provided by Kuruvi ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you don't agree, please don't use Kuruvi.
1. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use Kuruvi. By signing up, you confirm that you meet these requirements and that the information you provide is accurate.
2. Your account
You're responsible for keeping your sign-in credentials secure and for everything that happens under your account. Notify us immediately at hello@kuruvi.com if you suspect unauthorised access.
You may grant access to additional team members on paid plans. You're responsible for their use of the Service in line with these Terms.
3. Acceptable use
You agree not to:
- Use Kuruvi to send spam, unsolicited bulk messages, or violate any anti-spam, marketing, or messaging laws (including CAN-SPAM, GDPR ePrivacy, India's TRAI regulations, and the WhatsApp Business Terms).
- Send harassing, threatening, hateful, fraudulent, sexually explicit, or otherwise unlawful content.
- Attempt to reverse-engineer, decompile, or interfere with the Service.
- Use the Service to operate a competing product or train a machine-learning model on customer data.
- Share access credentials, resell the Service, or use the Service on behalf of someone whose account we've terminated.
We may suspend or terminate accounts that violate these rules, with or without notice.
4. Third-party services
Kuruvi connects to third-party platforms — including WhatsApp Business, Instagram, Facebook Messenger, Shopify, and our payment processor Stripe — to provide the Service. Your use of those platforms is governed by their own terms. We're not responsible for outages, policy changes, or actions taken by those platforms. If they suspend or change access, your experience of Kuruvi may be affected.
5. Subscriptions and billing
Kuruvi is offered on a subscription basis. By starting a paid plan you authorise us, via our payment processor, to charge your card the listed amount each billing cycle until you cancel.
Prices are shown in US dollars unless otherwise specified. Taxes (GST, VAT, sales tax) may be added depending on your billing location. We may change prices with at least 30 days' notice. Changes take effect at the start of your next billing cycle.
6. Free trials
Paid plans may offer a free trial period. At the end of the trial, the plan auto-renews unless you cancel. We'll send a reminder before the trial ends.
7. Refunds and cancellation
You can cancel anytime from your account settings. Cancellation stops future charges; we don't pro-rate refunds for partial months unless required by law. If we materially reduce the Service in a way that significantly affects you, you may request a pro-rated refund for the unused portion.
8. Beta features
From time to time we may offer beta or preview features. They are provided "as-is", may be changed or removed at any time, and may have performance or reliability limitations. Don't rely on beta features for business-critical operations.
9. Your content
You retain all ownership of the content you send and receive through Kuruvi (your "Content"). You grant us a limited, worldwide, royalty-free licence to host, store, transmit, and display your Content solely to provide the Service. We don't claim any other rights to your Content.
10. Our intellectual property
The Kuruvi app, website, brand, and underlying code are owned by us and are protected by intellectual property laws. These Terms don't transfer any of those rights to you, except for the limited right to use the Service under your subscription.
11. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
12. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted, secure, or error-free, or that any specific message will be delivered. To the extent permitted by law, we disclaim all implied warranties.
13. Limitation of liability
To the maximum extent permitted by law, Kuruvi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US $100.
14. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your Content, or your breach of these Terms.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you breach these Terms, use the Service in a way that exposes us to legal risk, or fail to pay. On termination, your right to use the Service ends and we may delete your data after a reasonable grace period, subject to the retention obligations in our Privacy Policy.
16. Changes to these Terms
We may update these Terms from time to time. We'll change the "Last updated" date and, for material changes, notify you by email or in-app at least 14 days before the change takes effect. Continued use of the Service after that date constitutes acceptance.
17. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflicts-of-law rules. Any dispute will be resolved in the courts of Chennai, Tamil Nadu, unless mandatory consumer law in your country requires otherwise. Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.
